SALES AGREEMENT

 

Allunique is a brand owned by Unique Brands Tekstil San. Tic. A.Ş.

Article 2 - Subject

 

This agreement regulates the mutual rights and obligations between the Consumer placing an order for the product specified below through allunique.com.tr and the Seller, the owner of this website, in accordance with Law No. 4822 Amending the Consumer Protection Law No. 4077 and the Regulation on Distance Contracts.

Article 5 - General Terms

 

5.1. Individuals under 18 years of age cannot shop on allunique.com.tr. By confirming this agreement electronically, the Consumer declares that they are over 18 years old.

 

5.2. The Seller is not responsible for any pricing or content errors on allunique.com.tr that may arise due to typographical or system errors. The Seller reserves the right to cancel orders with incorrect pricing.

 

5.3. Purchases made on allunique.com.tr are for personal use only and cannot be resold.

 

5.4. By confirming this agreement electronically, the Consumer acknowledges that they have been provided with accurate and complete information regarding the Seller’s address, phone number, order details, product specifications, total price (including taxes), payment methods, and delivery information before concluding the distance contract.

 

5.5. If the product price is not paid or is canceled in the bank records, the Seller is not obliged to deliver the product.

 

5.6. Orders placed via bank transfer or EFT will be processed only after the payment is received in the Seller’s bank account. If the payment is not made within one week, the Seller reserves the right to cancel the order.

 

5.7. If payment is made via credit card, and after the product is delivered, the credit card is used fraudulently by unauthorized persons, and the bank or financial institution does not transfer the payment to the Seller, the Consumer must return the product within 3 days.

 

 

Article 6 - Obligations of the Seller

 

6.1. The Seller shall fulfill the order within 30 days from the time it is received. This period may be extended by 10 additional days if the Consumer is notified in writing.

 

6.2. The Seller is not responsible for any delivery issues caused by the shipping company or if the recipient at the delivery address refuses to accept the package.

 

6.3. If necessary, the Seller may offer a product of equal quality and price before the delivery period expires.

 

6.4. If it is impossible to fulfill the order, the Seller shall notify the Consumer before the contract period ends and refund the payment within 10 days.

 

6.5. The Consumer has the right to withdraw from the contract within 14 days from the delivery date. To use this right, the Consumer must notify the Seller via email, phone, or the contact form on allunique.com.tr, and the product must not be among the non-returnable items listed in Article 7.

 

6.6. The Seller reserves the right to reject unauthorized returns.

 

6.7. The Consumer or the recipient must return the product along with its invoice, receipt, warranty, insurance documents, original box, and all accessories in their original condition.

 

6.8. If the invoice is not provided, the VAT and other applicable charges will not be refunded.

 

6.9. The Consumer is responsible for any damages, loss, or depreciation during the return process caused by improper handling or shipping issues.

 

6.10. Once the return is approved, the refund will be processed within 7 days.

 

 

Article 7 - Non-Returnable Products

 

The right of withdrawal cannot be exercised for products that are:

• Customized based on the Consumer’s request (e.g., engraved or modified items).

• Made-to-order or specifically tailored for the Consumer.

 

 

 

Article 8 - Jurisdiction

 

For disputes arising from this contract, the Consumer may apply to:

• Consumer Arbitration Committees (for disputes within the monetary limits set by the Ministry of Trade), or

• Consumer Courts in the jurisdiction of the Consumer’s or Seller’s residence.

 

Upon completing the order, the Consumer is deemed to have accepted all terms of this agreement.
